Terms and Conditions
Thank you for taking the time to look at our terms and conditions, which are applied to all orders that are placed with Aquapets Northwest Ltd t/a Aquatic Biotope.
Please note that these terms and conditions comply with Distance Selling Regulations (2000) and are designed to both protect the consumer and the retailer. By placing an order online upon our website you will have confirmed your acceptance of these terms and conditions.
Deliveries
1. Aquapets Northwest Ltd t/a Aquatic Biotope normally delivers using a next working day signed for service, however some item may take 2-5 working days. Where goods are not received within 21 days Aquatic Biotope will refund in full, or at your request supply an alternative product at the revised price. In addition, Aquatic Biotope will as a gesture of goodwill, supply the alternative product with a 5% discount on our advertised price.
2. Goods must be signed for upon delivery and any damages/shortages reported to us via email to deliveries@aquatic-biotope.co.uk. within 2 working days.
3. Aquapets Northwest Ltd t/a Aquatic Biotope, offers a free delivery service on most orders above £50.00 within delivery Zone A & Zone B only. This excludes Aquariums, Cabinets and very Large or Heavy items not handled by our normally carrier. These should be agreed prior to ordering. Normal products up to 25kg and within the maximum standard dimension 120x70x70cm are subject to the following conditions:
Where your order value is £50.00 and above, deliveries to Zone C will be £10.00. See below for further details.
Where your order value is £50.00 and above, deliveries to Zone D will be £14.00. See below for further details.
i. Orders up to and including £49.99 are subject to a minimum £5.00 delivery charge, within delivery Zone A & Zone B only.
ii. Order up to and including £49.99, deliveries to Zone C will be £15.00. See below for further details.
iii. Order up to and including £49.99, deliveries to Zone D will be £19.00. See below for further details.

4. Aquapets Northwest Ltd t/a Aquatic Biotope denies any liability for any consequential loss caused by faulty or damaged goods, delays in supply or delays by third party carriers. Where a delivery does not arrive on time, any additional delivery charge will be refunded. We do not accept any liability for third party contractors, and recommend leaving any installation arrangements until you are in receipt of your products.
Returns
1. There are a number of instances when it may be necessary to return goods to Aquapets Northwest Ltd t/a Aquatic Biotope. There is a specific process, which needs to be undertaken with reference to these situations in order to comply with the Distance Selling Regulations (2000). These are as follows:
2. You can cancel your order up to 30 days from the date your products are received. To cancel a product please email our returns department at returns@aquatic-biotope.co.uk. Under no circumstances must you return a product without first obtaining a returns reference, and advice on the procedure to follow. The customer is responsible for the costs incurred returning the goods, and will be responsible for any damage that may be incurred during their return.
3. All products returned under our returns scheme will remain the responsibility of the customer, without a Proof of Delivery to Aquapets Northwest Ltd t/a Aquatic Biotope.
4. The customer must ensure that any returned products are packaged so that damage is avoided in transit. All products must be returned via a signed for, or recorded delivery service.
5. Aquapets Northwest Ltd t/a Aquatic Biotope does not accept responsibility for losted or damaged goods returned by a customer, which are damaged in transit due to being poorly packed, or otherwise mislaid or mishandled by there carrier.
6. When a product is returned to Aquapets Northwest Ltd t/a Aquatic Biotope, in an unopened, unused and saleable condition, we will refund the full purchase price, less any delivery charges. We reserve the right to reject any returned products which are not fully saleable and in a new condition. A 15% Re-stocking/packaging charge will be applied to make goods saleable, and deducted from any refund.
7. Products cannot be returned after 30 days except with our written approval. This does not affect your statutory rights.
8. Products found to be faulty during the manufacturer's guarantee period must not be returned until you have emailed support@aquatic-biotope.co.uk, to obtain a returns reference and instructions on the procedure to take. Where a product is found to be faulty we reserve the right to offer an exchange or refund. Where a product is normally repaired during the warranty period, we will normally supply the appropriate replacement part/s. If it is necessary to send the faulty unit back to Aquapets Northwest Ltd t/a Aquatic Biotope then this will be done at the customers cost. If a replacement unit is required, then this will not be despatched to the customer until the faulty unit has been received by Aquapets Northwest Ltd t/a Aquatic Biotope, as is common practice when working with mail order and Internet based businesses.
9. All faulty products within the manufacturers guarantee period will undergo checks to ascertain whether the fault is covered by the guarantee. Where a product is found to have been damaged or misused, they are unlikely to be covered by the guarantee, and we will therefore refer the item to the manufacturer for further tests to identify the cause of the failure, and whether a claim is valid.
10. Where products have been specially ordered or made we cannot accept returns for refund or exchange unless they are faulty under the terms of the manufacturers guarantee. The list of products is not exhaustive but will include Plants Collections, Pond Liners, Pond Underlay, Specially Adapted Products.
11. Products ordered via our Special Orders Service, and not normally listed on the Aquatic Biotope online website, cannot be returned unless faulty.
12. Products are supplied in good faith, using the product will imply your acceptance of the product.
13. Your statutory rights are not affected by our returns policy.
Price Beating Policy
Our price beating policy is restricted to a maximum of 5 products of any one type, per household, per order. The products supplied under this offer are strictly for your own use, and not for resale. This policy is not available to any retailer or reseller. We will offer 5% off any genuine advertised price of any identical new product, which you find cheaper at a Vat Registered UK Retailer, which is not a clearance, special offer, or on Ebay or other Auction websites. We reserve to right to withdraw/cancel this offer without notice at any time.
Privacy Policy
Aquapets Northwest Ltd t/a Aquatic Biotope does not disclose any information to any third parties, other than shipping details to the relevant courier companies. Whilst our website does utilise cookies, this is purely to enable the shopping cart to function and no customer information is stored on our servers that is accessible in the public domain.
